Bachelor, Master and cantonal bar examinations

The exam

Bachelor, Master and cantonal bar examinations

Swiss federal law for law school and the bar: the Civil Code and the Code of Obligations, company law, civil procedure and debt enforcement, criminal law and procedure, and constitutional and administrative law with fundamental rights. Each canton runs its own bar examination; cantonal exam rules are not yet modelled one by one in the course.

Law school and the bar exam in Switzerland

Legal education in Switzerland is divided into a Bachelor and a Master. If you want to work as a lawyer you also need the bar licence. The requirements are set by the federal law on the free movement of lawyers (BGFA), in particular Art. 7: a law degree and an internship. Each canton organises the bar exam itself. It typically consists of a written and an oral part, though cantonal examination rules differ, for example in subjects and procedure.

The course concentrates on federal law, which forms the core of the exams in all cantons. Cantonal examination rules are not yet modelled one by one in the course; ask the bar examination commission of your canton about subjects and procedure.

The four core modules

Civil law covers the Civil Code (ZGB) and the Code of Obligations: persons, family, succession and property law, contract formation, defects of consent, performance and non-performance, sale, lease, employment contracts, tort liability and unjust enrichment. The second module combines company law, civil procedure and the Debt Enforcement and Bankruptcy Act (SchKG) with enforcement proceedings, objection, attachment and bankruptcy. Then come criminal law and criminal procedure with the general part, the main offences, coercive measures and main proceedings, and finally constitutional and administrative law with fundamental rights.

Each module has 18 lessons. Current topics are included, such as the 2023 company law reform with the capital band and sexual offences law after the 2024 revision.

Typical traps

Switzerland has its own concepts: A restriction of a fundamental right follows Art. 36 of the Federal Constitution with legal basis, public interest, proportionality and essence of the right. In debt enforcement timing often decides: objection, deadlines and whether a claim was already due. In the law of obligations limitation and forfeiture are easily confused. If you know German law you cannot count on equivalence: the Civil Code has its own form of protection for good faith.

There is also style: exams demand structured case analysis, which in Switzerland likewise rests on subsumption but weighs arguments with its own accents.

How to study with the Switzerland course

Lessons and flashcards carry the material, cases train application and timed exams practise written analysis. The statute library lets you read cited articles directly. Lexxi explains rules and asks back.

If you come from Germany or Austria, watch consciously for differences, for example in the fundamental-rights test or in the SchKG, which exists in this form only in Switzerland.
